1. Publisher

kScratch is published by 4urcloud (4urcloud.eu), a company registered in France. By using kScratch, you agree to these terms.

2. License

kScratch is provided under a commercial license. A 14-day free trial is available without a license key. After the trial period, a valid Pro or Lifetime license is required for continued use. License keys are personal and non-transferable.

3. Disclaimer of Warranty

kScratch is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied. This includes, but is not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

4urcloud does not warrant that the software will be uninterrupted, error-free, or free of harmful components. The entire risk as to the quality and performance of the software is with you.

4. Limitation of Liability

In no event shall 4urcloud, its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, kScratch. This includes, without limitation:

• Loss of data or corruption of Kubernetes resources
• Unintended modifications to clusters, deployments, or configurations
• Downtime, service interruptions, or infrastructure damage
• Security breaches or unauthorized access resulting from the use of the software
• Any financial losses, lost profits, or business interruption

This limitation applies regardless of the theory of liability, whether in contract, tort (including negligence), strict liability, or otherwise, even if 4urcloud has been advised of the possibility of such damages.

5. Kubernetes Operations

kScratch interacts directly with your Kubernetes clusters via the Kubernetes API. You are solely responsible for all operations performed through kScratch, including but not limited to creating, modifying, or deleting resources. 4urcloud is not responsible for any consequences resulting from these operations.

You should always maintain proper backups and follow your organization's change management procedures when managing production clusters.

6. Data & Privacy

kScratch does not collect telemetry, cluster data, or usage analytics. All Kubernetes communications happen directly between the application on your machine and your cluster API servers. No data transits through 4urcloud servers.

Account information (email, name) is stored securely for license management purposes only. Payment processing is handled by Stripe. 4urcloud does not store credit card information.

7. Refund Policy

We offer a 14-day money-back guarantee on all paid licenses. If you are not satisfied with kScratch, contact us at contact@kscratch.app within 14 days of purchase for a full refund.

8. Changes to Terms

4urcloud reserves the right to modify these terms at any time. Continued use of kScratch after changes constitutes acceptance of the updated terms.

9. Governing Law

These terms are governed by and construed in accordance with the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of France.
